easykind Terms & Conditions

By accessing and using the easykind website (https://easykind.com.au) (Website), our patient portal (Portal), or engaging with our Telehealth services, you agree to be bound by the following Terms of Service. You also agree that you have read and agree to our Privacy Policy and our Patient First Commitment. Please read these terms carefully before proceeding.

The Terms which apply at the time you book a consultation, access the Website or Portal, or request or receive a Service are those that govern your access to that Service.

We may review and update these Terms from time to time. Any variation will take effect from the date of publication and your continued use of the Services will be bound by those varied terms.

A. Introduction
1. Outline of parties and services

Green Australia Clinics Pty Ltd (trading as easykind) (we, us, our) operates an online telehealth platform for alternative healthcare treatment. We provide these services through our Website and on the Portal.

The services we provide (Services) include:

a. Facilitating communications between you and:

i. Medical and administrative staff (including patient support and nursing staff) acting on our behalf;
ii. Third party health service providers and practitioners who have an arrangement with us but do not act on our behalf (such as the Preferred Pharmacy and Partner Practitioners)
iii. Associate Couriers.

b. Providing the following services and products:

i. Access to the Portal;
ii. Facilitating your purchase and the fulfilment of medication from a Preferred Pharmacy for scripts issued by Partner Practitioners; and
iii. Facilitating the delivery of medication and other products from the Preferred Pharmacy;
iv. facilitating the delivery to you of prescription medications and other products from Associate Pharmacies via third party courier (Associate Couriers).

2. Reservation of rights

We reserve the right to

i. Terminate, block or suspend your access to the Portal, and modify or remove any material made available on the Website or Portal without notice and for any reason including non-compliance with these Terms; and
ii. Refuse to provide or supply you with any Services offered by us

B. The Portal and our Services
3. The Portal

Subject to the terms of this Agreement, easykind grants you a non-transferable, non-exclusive license to access and use the Website, Portal and Services for your personal, non-commercial use. easykind reserves the right, with or without notice, to modify, suspend, or discontinue the Website, Portal or Services, or any part thereof, at any time.

The Services provided through the Portal or the Website are only available to individuals who:

i. are over 18 years old;
ii. reside in Australia;
iii. access the Services within Australia;
iv. are capable of entering a legally binding agreement with us;
v. are capable of consenting to medical treatment (as determined by a Partner Practitioner); and
vi. agree to these Terms and our Privacy Policy.

4. Setting up and maintaining an account

In order to access the features of the Portal, you can elect to create an account with easykind.

4.1 Privacy

When you register for an Account you will provide us with personal information about you, including your name, age, date of birth, gender, contact details and sensitive information, such as health information. Any information collected will be processed, used and stored according to our Privacy Policy and any Collection Notice available at the point of collection at the time your information is collected.

The Portal will display personal and sensitive information including health information, such as your consultation history, medical history and medication prescribed to you. By using the Portal you consent to such information being stored and accessible on the Portal for the purpose of facilitating your access to our Services, order medication, and other purposes reasonably required to allow you to benefit from our Services.

You agree that all information you provide via the Portal, website, over the phone or by email (including to Partner Practitioners, Preferred Pharmacies, and Associate Couriers) will be true, accurate, up-to-date and complete and that you will not omit any information that is requested of you, or that a reasonable person would consider relevant to the Services you seek. We reserve the right to suspend or cancel your access to the Portal, or not provide any Services to you if any information you provide is inaccurate or incomplete.

4.2 Login and Account Association

To register for an account and access the Portal you will be required to create a password. You are solely responsible for the activity that occurs on your account and you must keep your account password secure. You may not use another user’s account and may not cause or allow another person to use your account. If you suspect or become aware of any unauthorised use of your account or that your password is no longer secure, you must notify us immediately and change your password. We won’t be responsible to you for, and expressly disclaim any liability for, any cost, loss, damages or expenses arising out of a failure by you to maintain the security of your Portal account information or your password.

We may terminate your account or restrict your access to the Portal. If this occurs in respect of your account, you may be prevented from accessing all or parts of the Portal, including your account details or other content contained in your account. We will not be liable to you or any third party for cancelling your account or restricting your access to the Portal.

easykind may occasionally suspend or restrict access to the Website or Services to perform maintenance or address technical issues.

4.3 Promotional Communications

If you have provided us with your phone number, you agree that easykind and those acting on its behalf may send you text (SMS) messages or call you in relation to promotions. Standard text messaging charges applied by your phone carrier will apply to text messages we send. If you change or deactivate the phone number you provided to easykind, you must update your account information to help prevent us from inadvertently communicating with anyone who acquires your old number. You may opt out of receiving promotional communications by advising us at the time of calling or following the opt-out instructions in promotional text messages.

If you have provided your email address, you agree that we may send you emails about the Services and promotional material connected to the Services. You may opt out of promotional emails by following the unsubscribe instructions in a promotional email.

Your agreement to receive promotional texts, calls or emails is not a condition of any purchase or service offered by easykind.

5. Services
5.1 Partner Practitioners
a. Clinical independence

Partner Practitioners are not employees of easykind and operate independently. When you have a consultation with a Partner Practitioner, you enter into a practitioner-patient treatment relationship with that Partner Practitioner. We are not a party to that relationship and are not liable for any services (including the provision of medical advice, the prescribing of medicines and compliance with privacy laws) provided as part of that relationship. We take no responsibility and make no warranties, express or implied, in relation to the content of any consultation between you and a Partner Practitioner (including any medical advice provided, prescriptions given or medicine or medical device recommended or supplied by a Partner Practitioner).

b. Treatment Disclaimers

We do not guarantee that a consultation with a Partner Practitioner is suitable for you or is the appropriate course of treatment for your particular health condition. The Partner Practitioner with whom you consult will determine your suitability for telehealth, the appropriateness of a treatment option, and whether any other health services are required. You acknowledge that a Partner Practitioner may, in their absolute discretion, refuse to prescribe medication to you, issue you a repeat prescription and/or provide any other services or referrals requested by you. You agree that this is a clinical decision made with your informed consent.

You acknowledge that the Services do not include general medical advice from the Partner Practitioners and instead only contemplate specific medical advice, including the assessment of prior diagnoses, and the issuing of prescriptions for recognised conditions. You acknowledge that your Partner Practitioner does not replace the role of a general medical practitioner.

You agree that the fact that a Partner Practitioner prescribes you a particular medicine does not constitute a representation that that medicine is available for dispensing (whether from a Preferred Pharmacy or otherwise) and we make no warranties about the available supply of prescribed medication.

c. Safety

If a Partner Practitioner prescribes you a medicine, you must carefully read all information provided to you about that medicine and follow any medical advice provided to you by a Partner Practitioner in relation to any prescribed medicine. It is your responsibility to advise your general medical practitioner of any medicines or treatments our Partner Practitioners have prescribed you. Partner Practitioners can communicate such information to your general medical practitioner on your behalf at your request. You agree that, if you suffer from any noticeable side effects from any medication or treatment you receive, you will either consult your general medical practitioner or contact us to facilitate a further consultation with a Partner Practitioner.

5.2 Appointment Policy

The advertising of any medical consultation or other health services (Services) on our website is merely an invitation to treat and a customer in booking a Service is making an offer to us to purchase Services. The agreement to provide Services only comes into existence upon our acceptance, which occurs when we book a consultation for you with a Partner Practitioner. By making a booking request, you acknowledge that you are making an offer to us to provide Services to you and the offer does not constitute a binding contract until we accept the offer. Unfortunately, we cannot guarantee that you will be able to consult with a particular Partner Practitioner.

We reserve the right to accept or reject a booking request for any reason, including;

a. an incomplete booking request.
b. the information contained in any advertisement of a Service being incorrect;
c. a determination in our discretion that we are unable to provide you with adequate care for your particular needs or circumstances; or
d. the unavailability of the Services from time to time.

In the event that we reject a Customer’s booking, we will refund any amount paid.

5.3 Conduct and Respect

We are committed to providing a safe, inclusive, and respectful environment for all staff. Discriminatory, abusive, or inappropriate behaviour — including but not limited to racism, homophobia, transphobia, sexism, or harassment of any kind — is strictly prohibited and will not be tolerated. By using our Services, you agree to treat all staff with dignity and respect, regardless of race, ethnicity, gender identity, sexual orientation, religion, disability, or background. Failure to comply with this requirement will result in discharge.

5.4 Payment and Cancellations

easykind’s consultation fees and charging practices can be found on our website (easykind.com.au/pricing). You agree to pay the fees for consultations as outlined at the time of booking. Payment for a consultation must be made prior to the commencement of a booked consultation. It is also a condition of us providing you with our Services that you complete a Patient Intake Form (PIF) prior to your consultation.

Requests to reschedule or cancel must be communicated at least 24 hours prior to the consultation start time. If you do not attend your consultation and your absence has not been communicated 24 hours prior, you may be required to pay again to rebook another consult.

Your appointment may be cancelled by easykind for any reason at our discretion, including occasions where:

a. you are not contactable 10 minutes after your appointment start time;
b. payment has not been received 24 hours prior to the consultation;
c. you fail to complete the PIF prior to your consultation;
d. you are deemed unsuitable for our Services prior to the consultation; or
e. you breach clause 5.3 above.

If your appointment is cancelled, you may be required to pay again to secure another appointment time.

6. Acceptable use of the Portal, Website and Services

You must not:

a. license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Website, Portal or Services;
b. modify, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the Website, Portal or Services
c. access the Website, Portal or Services to build a similar or competitive service;
d. attempt to breach the security of the Portal or use the Portal in a manner that may interfere with, disrupt or create undue burden on the Portal or the servers or networks that host the Portal;
e. use the Portal or Website to transmit or communicate any content or engage in any conduct that is unlawful, harmful, threatening, abusive, tortious, defamatory, offensive, breaches another person’s privacy, hateful or racially, ethnically or otherwise objectionable or discriminatory;
f. act in a way that may diminish or adversely impact the reputation of easykind, including by linking to the Portal on any other website;
g. disclose, transfer or on-sell information, data or other materials obtained from this Portal to any third party (including in public forums or on social media);
h. use, or attempt to use, the Portal in a manner that is illegal or fraudulent or facilitates illegal or fraudulent activity.

7. Purchase, dispensing and delivery of medicines

easykind is not a pharmacy and does not dispense medication. Instead, we facilitate your purchase of medication from and access to the services of iHealth Pharmacy Pty Ltd (ACN: 663 229 561) (Preferred Pharmacy).

Your order and the dispensing of orders from the Preferred Pharmacy is governed by the terms set out in this clause 7, as well as any terms communicated to you by the Preferred Pharmacy or available on their website (www.ihealthpharmacy.com.au) at the time of purchase.

7.1 Preferred Pharmacy

If you are prescribed a medicine, you may choose the pharmacy from which to have the prescription dispensed. If you choose our Preferred Pharmacy, we will transmit your prescription to the Preferred Pharmacy for dispensing. If the Preferred Pharmacy agrees to dispense your medicine, then you enter into a separate contract with them for the purchase of that medicine.

Through the Portal, we will process payment and transmit to the Preferred Pharmacy, send order details and personal information necessary to complete your purchase. For that purpose, you consent to us providing your personal and health information to, and contacting on your behalf, the Preferred Pharmacy in accordance with our Privacy Policy. You also consent to us sharing with and receiving from the Preferred Pharmacy details about your prescription in order to facilitate the proper dispensing of your medicine.

easykind has no control over and makes no warranties, express or implied, in relation to the correct dispensing of, or the decision of whether to dispense your medicines by the Preferred Pharmacy. You may be contacted directly by easykind, a related company, or the Preferred Pharmacy to facilitate your order, receive information about your product, or receive instructions on how to return a product.

If you choose to have your prescription dispensed by a pharmacy which is not a Preferred Pharmacy, you should advise our Patient Support Team. We will arrange to have your prescription transmitted either to you or to your chosen pharmacy. If you do choose an alternative pharmacy, you acknowledge that easykind cannot guarantee delivery times, service times or the quality or safety of any medication dispensed to you by any external pharmacy. You also acknowledge that you may be charged an administrative fee for the service of communicating with the external pharmacy, and collating and transmitting necessary documentation.

7.2 Counselling and dispensing of orders

For all initial medication purchases from the Preferred Pharmacy, you will receive counselling from a pharmacist on proper directions of use of your medication (‘Counselling Call’). For this purpose, you will receive a phone call from a pharmacist within 1 business day of placing an order via the Portal or over the phone.

It is a condition of the dispensing of any medication from the Preferred Pharmacy that you answer this call. By purchasing medication through the Portal or over the phone you acknowledge that your order will not be dispensed or dispatched until the Counselling Call has taken place. If you remain uncontactable for 5 business days after the order was placed, your order cost will be refunded to you on the original payment method.

It is your responsibility to ensure that your contact details are correct and that you are contactable for this purpose. The Preferred Pharmacy will not be liable for any delays caused by incorrect information being provided or your failure to keep your information up to date.  If you miss or are unable to take a Counselling Call when requested, if your treatment or medical conditions change, or if you are unsure about the proper use of your medication, you must contact the Patient Support Team or call the Preferred Pharmacy directly to request a Counselling Call.

7.3 Delivery or collection of orders

Your contract with the Preferred Pharmacy includes the arrangement of an Associate Courier or other service to deliver purchased orders and the Preferred Pharmacy remains responsible for the delivery of goods. From the point of dispatch, we will facilitate and manage the delivery of purchased orders on behalf of the Preferred Pharmacy. This may include receiving and resolving delivery questions and complaints, assisting you with delivery issues, communicating with the Associate Courier, and facilitating refunds and credit notes.

The sale of your medications occurs upon your order leaving the dispensing pharmacy and the title to your medications passes to you at that time. You are the legal owner of the medications and are responsible for those medications.

All deliveries or pickup orders from the Preferred Pharmacy require a signature and photo identification upon receipt to ensure your privacy and the safe delivery of your medications. Prescription products cannot be given an authority to leave direction.

If you opt for delivery, orders sent from the Preferred Pharmacy will be delivered by an Associate Courier. You are responsible for ensuring that you have appropriate arrangements in place to accept delivery of your medicine. We are not responsible for the actions of an Associate Courier.

You may be provided with a tracking link and/or an estimated delivery time frame. You acknowledge that this is an estimate only and may be impacted by your failure to provide complete or correct information, or other reasons outside our or the Preferred Pharmacy’s control.

7.4 Free or discounted delivery

Free or discounted delivery may be available for orders above a certain total order amount (calculated as the total cost of all purchased products excluding any applicable card surcharge fee). The relevant order amount will be communicated at the point of sale. No refund of the delivery fees is provided if you cancel your order after the delivery driver has been dispatched, or if there is no-one to receive it, or if you provide an incorrect address, or if you are unable to provide valid photo identification to the driver. A further charge of $15 will apply for failed deliveries returned to the Preferred Pharmacy.

Free or discounted delivery is not available for purchases made via Afterpay.

7.5 Payment for medication or other goods

When you make a purchase of medication or other goods through the Portal or over the phone, your payment information will be transmitted directly to the Preferred Pharmacy for processing. All payment is made directly to the Preferred Pharmacy, however we may process or otherwise facilitate payments made through the Portal on behalf of the Preferred Pharmacy.

If your order is cancelled after your medicine has been dispensed from the Preferred Pharmacy, you will be charged for the medication and you will not be able to obtain a refund. If you cancel an order after it has been collected by the Associate Courier, you will not receive a refund for any delivery fees.

a. Afterpay

Your purchase on the Portal may be eligible for payment via Afterpay.

Afterpay is a third-party payment service. If you opt to make purchases via Afterpay, you enter a separate contract with Afterpay and are liable for repayment to them on the terms available on their website. We are not responsible for Afterpay’s decisions regarding eligibility, payment approval, late fees, or any other aspect of the financing arrangement. We are unable to assist with disputes arising from the use of this service nor are we liable for any loss caused by your use of this service. You should consider your individual circumstances and ensure you have the financial means to make required repayments prior to entering into any agreement with Afterpay or making purchases using Afterpay.

Afterpay is only available for the purchase of goods made via the Portal (up to a maximum total cart value of $1500) or in-person at the Preferred Pharmacy. Afterpay is not available for the payment for Services from us (including consultations).

7.6 Missing Orders and Product Quality Issues

Your purchase of medication or medical devices is made directly from the Preferred Pharmacy, and easykind will not be responsible for damaged or faulty goods. However, easykind will facilitate the complaint and return process and manage order-related issues on behalf of the Preferred Pharmacy, including without limitation, providing customer service support for return and refund requests and receiving adverse event and damaged goods reports and complaints.

If your order appears to be damaged, wrongly dispensed or not delivered as expected, or there are issues with what has been received, please immediately (and not later than 7 days after receipt of the item) contact our support team on 1800 052 115 or [email protected]. Depending on your concern, we will provide guidance on follow-up actions.

 

Due to health regulations and the nature of pharmaceutical products, the Preferred Pharmacy is unable to accept returns or provide refunds for prescription medications or devices, and any other products that have been opened, used or tampered with (including without limitation products returned due to change of mind or patient ordering error), unless they are faulty, damaged, or incorrectly supplied. You must ensure all details entered or displayed at the time of purchase, including product name, strength, quantity, and delivery address, are accurate and complete.

7.7 Returns and Non-Returnable Goods

Returns will not be accepted without prior written authorisation. Where a return is approved, we will provide instructions for returning the goods. Where a valid claim is established, the Preferred Pharmacy may offer a remedy in the form of a refund, replacement, or credit, at their sole discretion.

Where a refund is approved, it will be processed to the original method of payment. For orders paid via third-party payment services such as Afterpay, refunds will be issued through the relevant provider in accordance with their terms and conditions. Refund processing times may vary depending on the payment provider.

C. General Provisions

8. Information on the Website

You agree to make your own enquiries to verify the information provided and to assess the suitability of the Services before You place a booking request. We are not responsible for any typographical, technical, or descriptive errors of the Services on the Website. If we become aware of the existence of such an error, we will do all things reasonably necessary to rectify such an error. To the extent permitted by the Australian Consumer Law, we will not be liable to any Customer for any loss or damage arising out of a Customer’s reliance upon any typographical, technical, or descriptive errors of products on the Website.

9. Links to third party websites

The Website or Portal may include links to other websites, content or resources. These linked websites, content or resources may be operated by third parties, and we may have no control over the operation of such websites. The existence of these links does not imply that we endorse the linked website, content or resource. You acknowledge that we have not reviewed any of these third-party websites, content or resources and are not responsible for the material contained therein.

10. User Generated Content

easykind is not responsible for any content which is posted by others on social media sites, including its accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, or quality.

If you are participating in social media forums hosted by easykind, you agree not to use those forums to collect, upload, transmit, display, or distribute any content that violates any laws or third party rights including their intellectual property rights; or, is unlawful, harassing, abusive, threatening, harmful, invasive of another’s privacy, defamatory, false, or patently offensive.

11. Intellectual Property

The copyright on the Website, Portal, copy, images, logos, indicia, text, content, and unique method of showcasing products is owned by easykind. The domain name www.easykind.com.au or any of the trademarks, logos or other material in which intellectual property rights subsist may not be used in advertising or publicity pertaining to distribution of this information without our prior written consent. Trademarks used on the Website and Portal which are owned by third parties are used with express permission and remain the intellectual property of the third party.

You shall not re-publish, transfer, copy, reproduce or post on the internet any content from the Website or Portal without our prior written consent.

You may not modify or copy the layout or appearance of the Website or Portal nor any computer software or code contained in the Website or Portal. You may not decompile or disassemble, reverse engineer or otherwise attempt to discover or access any source code related to the Website or Portal.

If you correspond or otherwise communicate with us, you grant us an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence to use, copy, display and distribute the content of your correspondence or communication and to prepare derivative works of the content or incorporate the content into other works in order to publish and promote such content. This may include, but is not limited to, publishing reviews on the Website or on social media and developing your ideas and suggestions for improved services.

12. Indemnity

In this clause, references to easykind include its officers, directors, contractors, employees, and agents. You agree to indemnify and hold easykind harmless from any losses, including reasonable legal costs and expenses, or liabilities incurred by easykind arising from any claim, demand, suit, action, or proceeding against easykind related to: (a) your violation of these Terms of Service, (b) your use of the Website, Portal or Services, or (c) your publication or distribution of any material or information.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. easykind shall not be liable for any loss or damage arising from your failure to comply with this security obligation.

13. Statutory Conditions and Warranty

Consumer Notice: Our Services may come with guarantees that cannot be excluded under the Australian Consumer Law.  Nothing in these Terms purports to modify or exclude the conditions, warranties, guarantees and undertakings, and other legal rights, under the Australian Consumer Law and other laws which cannot be modified or excluded.

Where any law implies a warranty into this agreement which may not be lawfully excluded then to the extent allowed by law (Warranty), any liability imposed upon us in respect of a breach of the Warranty will at our option be limited to the resupply of Services, the payment of the cost of resupply of the Services, the refund of the price paid for the Services.

To the extent permitted by law, we shall not be liable for any indirect or consequential damage, losses or expenses suffered or incurred by you, howsoever caused.

To issue a Warranty claim, you will be required to contact us within 14 days of the supply of Service at [email protected], present the receipt as proof of purchase of the Services and identify the defect in the Services.

14. Limitation of Liability 

Except as expressly set out in these Terms and the Australian Consumer Law, we make no warranties or other representations in relation to the supply of Services. Our liability in respect of these warranties, representations, undertakings and guarantees is limited to the fullest extent permitted by law.

You acknowledge and agree that to the maximum extent permitted by law, we will not be liable to you or any other person under any circumstances for any loss or damage suffered or incurred by you or for any injury or death to any person, or for any indirect, incidental or consequential damages sustained or incurred by you, whether such liability arises directly or indirectly as a result of any negligent act or omission or wilful misconduct by us or our employees or agents, the supply, performance or use of any Services any breach of our obligations under these Terms.

No other term, condition, agreement, warranty, representation or understanding (whether express or implied) in any way binding upon us, other than these Terms, is made or given by or on behalf of us. You are solely responsible for making an assessment that a Service is reasonably fit for your intended purpose and required use, and such purpose or required use is in accordance with all applicable laws.

We endeavour to provide Services with due care and skill but does not warrant that any Services will be provided without fault or disruption. To the extent allowed by law, we exclude all liability you or anyone else for loss or damage of any kind (however caused or arising) relating in any way to the Website or Portal including, but not limited to:

i. loss or damage you might suffer as a result of errors, mistakes or inaccuracies on the Website or Portal
ii. you acting, or failing to act, on any information contained on or referred to on the Website or Portal and/or any linked website;
iii. any unauthorised access to or use of our secure servers and information of any kind stored on those servers;
iv. any interruption or cessation of transmission to or from the Website or Portal;
v. any computer bugs, viruses, Trojan horses or other harmful code or communications which may be transmitted to or through the Website or Portal by any third party; and
vi. the merchantability or fitness for any purpose of any product or service of any website linked to or advertised on the Website or Portal.

We do not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party through the Website or Portal or any linked website or any products or services featured in any banner or other advertising. We will not be a party to or in any way responsible for monitoring any transaction between you and a third-party provider of products and services (including the Preferred Pharmacy).

15. Disclaimers

While easykind strives to provide accurate information, all material displayed on the website is provided without any guarantees, conditions, or warranties as to its accuracy. Any information accessed through the easykind website or services, including our chat widget, AI features, automated emails or social media pages, is for informational and educational purposes only and should not be considered a substitute for medical or health practitioner consultation. It is your responsibility to seek professional medical advice, diagnosis, or treatment. easykind is not responsible for any relationship you may have with practitioners, third parties, or other users of the website or services. We do not screen third parties for qualifications or authorisation to provide services, nor do we verify the accuracy of the information they provide. Consultations are subject to practitioner availability and easykind does not guarantee the availability of specific practitioners.

16. Complaints

If you believe that you have been incorrectly charged for a Service, or you have any other concern or complaint relating to the Services, please contact us at [email protected]. We will endeavour to respond to you, and resolve your complaint or concern, as soon as we are able.

If you believe that a user has breached any of these Terms, please contact us at [email protected].

17. Governing Law

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and any courts that may hear appeals from those courts in respect of any proceedings in connection with these Terms.

18. Campaign Disclaimers

From time to time, easykind may run promotional campaigns or special deals. By participating in these campaigns, you agree to abide by any terms and conditions communicated in the campaign advertisement as well as the expanded terms for the relevant campaign set out below.

Campaign offers are valid for the specified period only and may be limited to one use per patient.

Campaigns:

a. Friend referral – $10 off promotion.
  • For the referrer, the discount will be applied to the next follow-up consultation upon full payment by the referred person of the cost of their initial consultation.
  • For the referee, the discount will be applied to the cost of their initial consultation if they are considered suitable. Available to new patients only.
  • Discount applies only to the cost of the patient consultation and is not exchangeable or redeemable for any other purpose.
  • This offer cannot be used in conjunction with any other offer.
  • Each patient is assessed on a case-by-case basis. A referral in no way guarantees that a prospective patient will be booked in for a consultation, that they will be deemed suitable for the clinic, nor that a specific treatment will be deemed appropriate for them by a practitioner during a consultation.
b. Switching clinic campaign
  • Discount applies from 01/01/2025 to 31/01/2026 unless extended.
  • Discount applies to initial consultations for new patients only.
  • To access this promotion, patient must provide a letter indicating their discharge from another alternative healthcare provider.
  • Discount is valid for one use per patient.
  • This offer cannot be used in conjunction with any other offer.
  • Each patient is assessed on a case-by-case basis, and providing a discharge letter in no way guarantees that you will be booked in for a consultation, that you will be deemed suitable for the clinic, nor that a specific treatment will be deemed appropriate for you by a practitioner during a consultation.
c. $5 Off Follow-Up and Return Consultation promotion.
  • The discount will be applied to the consultation upon full payment if booked on the same day as the promotional message.
  • Discount applies only to the cost of the patient consultation and is not exchangeable or redeemable for any other purpose.
  • This offer cannot be used in conjunction with any other offer.
  • Each patient is assessed on a case-by-case basis. A promotional discount in no way guarantees that a prospective patient will be booked in for a consultation, that they will be deemed suitable for the clinic, nor that a specific treatment will be deemed appropriate for them by a practitioner during a consultation.
d. Black Friday Sale
  • Discount applies from 06/11/2025 to 01/12/2025 unless extended.
  • Discount applies to initial consultations with a doctor or nurse practitioner for new patients only.
  • Discount is valid for one use per patient.
  • This offer cannot be used in conjunction with any other offer.
  • Each patient is assessed on a case-by-case basis. A promotional discount in no way guarantees that you will be booked in for a consultation, that you will be deemed suitable for the clinic, nor that a specific treatment will be deemed appropriate for you by a practitioner during a consultation.
e. easykind Patient Feedback Survey – $100 Gift Card Draw
  • The purpose of this survey is to gather genuine patient feedback to help improve the clinical experience and overall quality of care provided by easykind.
  • All information collected through the survey is private and confidential. Responses are de-identified and used only to inform improvements.
  • These Terms and Conditions outline the basis on which the promotion is conducted and ensure compliance with relevant Victorian and Commonwealth legislation, including the Health Records Act 2001 (Vic) and the Privacy Act 1988 (Cth).

Eligibility:

  • Entry is open to current patients of easykind who are residents of Victoria and aged 18 years or over.
  • Employees and contractors of the Promoter are not eligible to enter.
  • Entry is free. No purchase, consultation, or payment of any kind is required to participate.
  • Participation in the survey and draw is voluntary and has no impact on any current or future medical treatment, prescribing decisions, or access to healthcare services.

Promotion Period:

  • The promotion opens at 9:00 am AEST on 7/11/2025 and closes at 5:00 pm AEST on 14/11/2025 (“Promotion Period”).
  • Entries received outside this period will not be accepted.

How to Enter:

  • To enter, eligible participants must complete and submit the easykind Patient Feedback Survey during the Promotion Period.
  • Each participant may enter only once.
  • Participants must provide their contact details (such as name, phone, or email) solely for the purpose of prize notification.
  • Survey responses are de-identified and used only to improve non-clinical services such as administration, communication, and patient support.
  • Feedback is not shared publicly and does not influence clinical care or treatment decisions.

Prize:

  • There are five (5) prizes, each consisting of a $100 Visa Gift Card.
  • The total prize pool is valued at $500 (including GST).
  • Prizes are not transferable or exchangeable and cannot be redeemed for cash.

Draw Details:

  • The draw will take place at easykind on 17/11/2025.
  • The winners will be selected by a random draw using a fair and auditable method.
  • Each valid entry has an equal chance of winning.
  • The draw will be conducted by the Promoter.

Notification of Winners:

  • Winners will be notified by email and/or phone within 14 days of the draw.
  • The winner’s first name and suburb may be published on the easykind website or social media channels.
  • To claim their prize, winners must respond within 7 days of notification.
  • If the Promoter cannot contact a winner or the prize is unclaimed, a redraw will be conducted on 24/11/2025 using the same method.

Privacy:

  • Personal information collected for this promotion (such as name and contact details) will be used solely for the purposes of administering the promotion and notifying winners.
  • Survey responses are stored separately and securely from contact details and cannot be linked to identifiable information.
  • All data is handled in accordance with the Health Records Act 2001 (Vic) and the Privacy Act 1988 (Cth) (if applicable).

General Conditions:

  • This promotion is conducted in Victoria under the conditions for a trade promotion lottery as set out in Part 3.6 of the Gambling Regulation Act 2003 (Vic) and the Gambling Regulation Regulations 2015 (Vic).
  • The promotion is not intended to advertise, promote, or supply any medicinal product or clinical service.
  • The feedback survey is for service improvement purposes only, and participation is entirely voluntary.
  • The Promoter’s decision in all matters relating to this promotion is final and no correspondence will be entered into.
  • The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or breaches these terms.

Record Keeping:

  • The Promoter will maintain records of the draw, entries, and prize distribution for a period of three (3) years to ensure compliance with Victorian regulations.
f. $0 consult campaign
  • Discount applies from 28/11/2025 to 19/12/2025 unless extended.
  • Discount applies to new or current patients after receiving an email or text about the campaign.
  • Discount is valid for one use per patient.This offer cannot be used in conjunction with any other offer.
  • Each patient is assessed on a case-by-case basis. A promotional discount in no way guarantees that you will be booked in for a consultation, that you will be deemed suitable for the clinic, nor that a specific treatment will be deemed appropriate for you by a practitioner during a consultation.
g. $0 Christmas referral campaign
  • Discount applies from 28/11/2025 to 19/12/2025 unless extended.
  • For the referee, the discount will be applied to the cost of their initial consultation if they are subject to pre-screening and Intake processes. Available to new patients only.
  • Discount applies only to the cost of the patient consultation and is not exchangeable or redeemable for any other purpose.
  • Discount is valid for one use per patient.
  • This offer cannot be used in conjunction with any other offer.
